The Cutchi Memons Act, 1938

The Cutchi Memons Act, 1938 is a key historical legislation that specifically applies to the Cutchi Memon community in matters of succession and inheritance. Before this Act, Cutchi Memons were largely governed by Hindu law in personal matters. This Act mandated that, from November 1, 1938, all Cutchi Memons would be governed by Muhammadan Law (Islamic law) in issues related to succession and inheritance. It represents an important shift in the legal system, aligning the personal law of this community with their religious identity. Section 3 protects any rights or legal proceedings that existed before the Act came into force. Although section 4 was later repealed, the core provision of applying Muslim personal law to the community remains significant for understanding the evolution of personal laws in India.
