Digital Personal Data Protection Act, 2023
The Digital Personal Data Protection Act, 2023 (DPDP Act) is a landmark legislation enacted by the Indian Parliament on 11th August 2023 to regulate the processing of digital personal data in India. It balances individuals' right to privacy with the lawful use of data for various purposes. The Act establishes obligations for Data Fiduciaries (entities handling data), grants rights to Data Principals (individuals), and introduces a Data Protection Board of India for enforcement. Key provisions include consent requirements, data breach notifications, special protections for children, and penalties for non-compliance. This Act modernizes India’s data governance framework, aligning it with global standards while addressing local needs. It replaces outdated provisions under the IT Act, 2000, emphasizing transparency, accountability, and user rights in the digital era.
