The Indian Treasure-trove Act, 1878

The Indian Treasure-trove Act, 1878, is a historical legislation that establishes the legal framework for dealing with discovered treasure in India. Enacted during the British colonial period, it remains an important part of property and revenue law, designed to systematically resolve claims over valuables hidden in the soil. The Act defines "treasure" as anything of value hidden underground or in attached structures and outlines a clear procedure for the finder to report the discovery to the Collector. It sets out rules for notifying potential claimants, determining ownership, and dividing the treasure between the finder and the rightful owner of the land. The Act also grants the government the power to acquire the treasure under specified conditions and imposes penalties for non-compliance. Its importance lies in providing a structured and fair legal process to prevent disputes and ensure that such discoveries are handled transparently and in accordance with the law.
