The Maharashtra Rent Control Act, 1999

The Maharashtra Rent Control Act, 1999 was enacted to modernize and consolidate rent control laws in Maharashtra, replacing the older Bombay Rents, Hotel and Lodging House Rates Control Act, 1947. The law aims to balance the interests of landlords and tenants by regulating rent, preventing unjust evictions, and ensuring fair housing practices. It applies to residential and commercial premises, fixing standard rents while allowing reasonable increases. Key provisions include defining protected tenants, outlining lawful grounds for eviction (such as non-payment, subletting, or bona fide landlord need), and establishing rent authorities for dispute resolution. The Act also exempts certain high-rent properties to encourage market-driven agreements. By streamlining procedures and addressing loopholes, it seeks to reduce litigation while safeguarding tenant rights and landlord interests in urban housing.
