The Surrogacy (Regulation) Act, 2021

The Surrogacy (Regulation) Act, 2021, enacted on 25th December 2021, aims to regulate surrogacy practices in India, ensuring ethical and legal standards. It prohibits commercial surrogacy, allowing only altruistic surrogacy to prevent exploitation of surrogate mothers and protect the rights of children born through surrogacy. The Act establishes National and State Boards to oversee compliance, mandates strict eligibility criteria for intending couples and surrogate mothers, and imposes penalties for violations. This legislation is significant in the Indian legal system as it addresses ethical concerns, promotes transparency, and safeguards the interests of all parties involved in surrogacy arrangements.
