Case Analysis Eagle Hunter Solutions Limited vs Ashok Kumar Tiwari 2026 DHC 2836

Synopsis

The management challenged a labour court award directing reinstatement of a workman with full back wages, continuity of service, and consequential benefits. The workman claimed his services were terminated illegally on 16.03.2013; the management contended he had absented himself after one site was closed and he was offered alternate deployment. The labour court found that the management had failed to prove that the workman was offered alternate employment or that he abandoned service, and held the termination illegal. The High Court, while upholding the finding of illegal termination, modified the relief from reinstatement with full back wages to a lump‑sum compensation of Rs. 8 lakhs, considering the workman’s age (57 years), the long passage of time, the settlement of wages under the Minimum Wages Act, and the fact that the workman had not actually rejoined despite a court direction.
