Despite this, the wife filed an application before the Assistant Commissioner under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The Assistant Commissioner granted maintenance and directed joint katha (land record entry) in the names of both parties. The Deputy Commissioner confirmed this order. The High Court quashed both orders, holding that a wife cannot invoke the Senior Citizens Act against her husband. The Act is protective of senior citizens, not adversarial against them. Authorities under the Act have no jurisdiction to decide matrimonial or property disputes between spouses, especially when civil court decrees have attained finality.
