Case Analysis Jeet Kumar Sohra vs Office of the Principal District and Sessions Judge Headquarters 2026 DHC 3213

Synopsis

The petitioner had earlier been granted promotion to the post of Upper Division Clerk (UDC) / Judicial Assistant w.e.f. 2nd January 2001 by a judgment of the High Court dated 13th September 2022. The petitioner claimed that upon completion of ten years of service, he became entitled to promotion to the post of Senior Judicial Assistant (SJA) w.e.f. 2nd January 2011, but this was denied on account of penalties imposed on him. In contempt proceedings, the petitioner contended that the penalties had been modified by an appellate order dated 12th May 2016, and the maximum conjoint penalty had been undergone even prior to 24th December 2013. The Delhi High Court held that the respondent had erred in granting promotion to SJA only w.e.f. 1st July 2016. The court directed the respondent to consider the petitioner’s case for promotion to SJA w.e.f. 24th December 2013 and to grant all consequential benefits. No contempt action was taken against the respondent.
