Synopsis

The petitioner obtained a decree from a Commercial Court declaring that a registered Joint Development Agreement (JDA) and a General Power of Attorney (GPA) stood terminated and cancelled, as the developer had failed to perform his obligations. When the petitioner approached the jurisdictional Sub‑Registrar to record the cancellation in the encumbrance register and other records, the Sub‑Registrar refused on the ground that the court had not directly communicated the decree to the registration office. The High Court allowed the writ petition, holding that: (i) Section 31(2) of the Specific Relief Act obligates the court to send a copy of the decree to the registering authority, but the absence of such communication does not empower the Sub‑Registrar to refuse to act on a certified copy produced by the party; (ii) the Sub‑Registrar’s role is ministerial, not adjudicatory; (iii) a certified copy of a decree carries statutory authenticity and must be acted upon; and (iv) the court issued guidelines for civil courts and registering authorities to ensure smooth implementation of such decrees in the future.
