Case Analysis Ms Karix Mobile Private Limited vs National Informatics Centre Services Inc & Ors 2026 DHC 2772-DB

Synopsis

The petitioner, an unsuccessful bidder, challenged the Letter of Empanelment issued by NICSI to Respondent No. 2 (Onextel) for Message Gateway Services. The challenge was based on the allegation that Respondent No. 2’s CMMI Level 5 certificate, issued by UK Certification & Inspection Ltd., was invalid because UKCert was not an authorized partner of ISACA (the owner of the CMMI framework). The Delhi High Court dismissed the writ petition, holding that: (i) the tender condition did not mandate certification from any specific agency; (ii) the tendering authority (NICSI) is the best judge of its requirements and its expert committee had accepted the certificate; (iii) the challenge was belated, filed only after the petitioner lost in the financial bid; and (iv) the petitioner’s own affiliate had previously submitted similar certifications from non-ISACA partners, estopping it from raising the objection. The court also noted that substantial public money (approx. Rs. 70 crores) would be saved by awarding the contract to the L1 bidder.
