Case Analysis Ms Vaibhav International vs The Commissioner Of Customs & Ors 2026 KHC 15737

Synopsis

The petitioner (M/s Vaibhav International) imported 28 MTs of roasted areca nuts from Indonesia and filed a Bill of Entry on 06.09.2024 classifying the goods under CTH 20081920 (Chapter 20 – preparations of nuts). The customs authorities initially sent samples to CRCL, which reported that the goods were roasted areca nuts. Without any valid reason, the authorities sent samples to ICAR‑CPCRI, which reported that the goods were raw/dried areca nuts. Based on the second report, the authorities seized the goods on 06.12.2024 and issued a show cause notice dated 17.12.2024 proposing re‑classification under Chapter 8 (raw areca nuts), higher duty demand, and confiscation. The petitioner filed multiple writ petitions challenging the seizure, the communication for provisional release, and the show cause notice. The High Court allowed all petitions, holding that: (i) the goods are roasted areca nuts classifiable under Chapter 20, not Chapter 8; (ii) the seizure and SCN were premature as provisional assessment had not been finalised; (iii) the valuation declared by the petitioner was to be accepted; and (iv) the subsequent DGFT notifications could not apply retrospectively.
