Case Analysis National Council For Teacher Education And Anr vs Holy Child Bed College & Anr 2026 DHC 3873-DB

Synopsis

A B.Ed college was granted recognition but failed to comply with NCTE norms regarding faculty, building completion certificate, and website maintenance despite multiple show cause notices and extended time. The Eastern Regional Committee withdrew recognition on 26.02.2020, and the NCTE dismissed the college’s appeal on 10.03.2021. The college filed a writ petition before the Delhi High Court. The learned Single Judge upheld the withdrawal and appellate orders as valid, but directed the Regional Committee to examine the college’s faculty list (submitted belatedly on 01.08.2022) and consider its eligibility for prospective academic sessions. The NCTE appealed. The Division Bench held that once the withdrawal order has attained finality and the college was in default for years (2017-2021), the belated appointment of faculty on 10.06.2022 and approval of the faculty list on 01.08.2022 could not revive the recognition. The college no longer had any faculty or affiliation. The direction for reconsideration was set aside, and the appeal was allowed.
