Synopsis
The petitioners had obtained a compromise decree in a suit challenging a sale deed of ancestral land. The decree provided that compensation received from the land acquisition authority would first be deposited in respondent No.1’s account, and thereafter he would pay the petitioners. Respondent No.1 received substantial compensation (approx. Rs. 22.91 crores) but failed to pay the decreetal amount. The petitioners filed an execution application. The Executing Court rejected it as “premature,” holding that full compensation had not yet been received and the decree was conditional. The Gujarat High Court quashed the order, holding that the Executing Court had misinterpreted the decree. The court noted that the petitioners were entitled to only Rs. 1.31 crores out of the total compensation received, and the condition (receipt of compensation) had been substantially satisfied. The matter was remanded for fresh adjudication.
