Case Analysis Shashikala Shrvankumar Rai & Ors vs Rameshkumar Narandas Sindhi & Ors C/FA/861/2015

Synopsis

The claimants (widow, minor children, and mother of the deceased) appealed against a Motor Accident Claims Tribunal award seeking enhancement of compensation. The Tribunal had awarded Rs. 5,31,700/- with interest at 7.5% per annum. The High Court partly allowed the appeal, upholding the Tribunal’s determination of the deceased’s monthly income at Rs. 1,900/- (rejecting the claim of Rs. 4,500/- due to lack of proof), but enhanced compensation under conventional heads (loss of consortium, loss of estate, funeral expenses) in accordance with Pranay Sethi (2017) and Magma General Insurance (2018). The court also modified the interest rate, awarding 15% from 1995 to 1997, 12% from 1997 to 2000, and 9% thereafter, following a Division Bench precedent of the Gujarat High Court.
