Case Analysis Toshar Kumar vs The Town Vending Committee 2026 DHC 2453-DB

Synopsis

This judgment by a Division Bench of the Delhi High Court disposes of a writ petition filed by a petitioner seeking the substitution of his name in place of his deceased father in the Certificate of Vending (CoV) issued under the Street Vendors Act. The petitioner's father, a street vendor, had been issued a CoV. After his death, the petitioner sought to have his name substituted as a dependent child, relying on Section 5(2) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. Since his representation was not decided, the court directed the Director Enforcement, NDMC, to verify the documents and decide the representation within a stipulated timeframe. The court also provided interim protection against coercive measures. The petition was disposed of with these directions.
