Case Analysis Vinubhai Govindbhai (Decd) Through Legal Heirs & Ors vs Owner of Tanker C/FA/60/2000

Synopsis

This judgment by the Gujarat High Court disposes of a first appeal filed by the original claimants (widow and minor son of the deceased) seeking enhancement of compensation awarded by the Motor Accident Claims Tribunal in a fatal accident case. The deceased, a 35-year-old driver, died in a motor vehicle accident on 01.12.2007. The Tribunal had awarded Rs. 5,11,000/-. The High Court, applying the principles laid down in landmark Supreme Court judgments (Pranay Sethi, Sarla Verma, Magma General Insurance), recalculated the compensation. It increased the notional income based on minimum wages, applied the correct multiplier (16 instead of 15), corrected the deduction for personal expenses, and enhanced the amounts under conventional heads, including granting consortium to the widow, minor son, and the deceased's parents. The total compensation was enhanced to Rs. 7,94,380/-, an increase of Rs. 2,83,380/-.
