Case Analysis D C Mishra vs Union of India & Ors 2026 DHC 3695-DB

Synopsis

The petitioner, a scientist, had filed multiple original applications before the Central Administrative Tribunal (CAT) challenging service‑related issues. The OAs were pending since 2012/2014. When the petitioner sought an adjournment to argue the matter or engage a counsel, the CAT dismissed all three OAs in a cryptic order. The Tribunal recorded adverse observations about the petitioner’s conduct (colleagues refusing to work with him, alleged violence, avoiding duty) and, even more troubling, directed that a copy of the order be sent to the Director General, ICAR, to have the petitioner examined by a medical board for “mental disabilities”. The High Court quashed the order, holding that the Tribunal acted in pique, exceeded its authority, and made inappropriate remarks about the petitioner’s mental health. The matter was remanded for fresh, dispassionate consideration on merits.
