2. Judgment in Brief

The Delhi High Court enhanced the compensation awarded to the family of a deceased Member of the Manipur Legislative Assembly who died in a road accident in 2011. The Motor Accidents Claims Tribunal (MACT) had computed the monthly income of the deceased at Rs. 18,500/- based only on his basic salary, excluding various allowances. The High Court held that allowances which accrue to the benefit of the family—such as entertainment allowance, contingency allowance, telephone allowance, housing allowance, water/electricity allowance, and driver's salary—must be included in the income for calculating loss of dependency. The Court applied the principles laid down in National Insurance Co. Ltd. v. Indira Srivastava, Vijay Kumar Rastogi v. UP SRTC, Meenakshi v. Oriental Insurance Co. Ltd., and National Insurance Company Ltd. v. Nalini, among others. The compensation was enhanced from Rs. 29,85,000/- to Rs. 87,17,740/-.


3. Relevant Facts

The Accident

  • The deceased, E. Suraj Singh, was a Member of the Manipur Legislative Assembly.

  • On the intervening night of 17th/18th August 2011, he was returning from Manipur Bhawan to Mayur Vihar in Delhi in a Santro Car when a collision occurred with a Jeep (offending vehicle) driven by respondent no.1.

  • The deceased sustained grievous injuries and was declared "brought dead" at LBS Hospital.

  • FIR No. 242/11 under sections 279/338/304A IPC was registered against respondent no.1.

  • The appellants/claimants—the wife and children of the deceased—filed a claim petition before MACT seeking compensation.

  • The MACT awarded Rs. 29,85,000/- as compensation, computing the deceased's monthly income at Rs. 18,500/- (basic salary) and excluding all other allowances.
