2. Judgment in Brief

The Delhi High Court dismissed a Regular First Appeal challenging the rejection of a plaint under Order VII Rule 11 CPC. The plaintiff claimed ownership of 145 sq. yards of property based on an unregistered Agreement to Sell, GPA, and Receipt dated 1998. The Trial Court rejected the suit on multiple grounds: (i) barred by res judicata due to an earlier suit dismissed on the same cause of action; (ii) barred by Order XXIII Rule 1 CPC as the previous appeal was withdrawn without permission to file a fresh suit; (iii) no cause of action as unregistered documents do not confer title; and (iv) barred by limitation. The High Court upheld the rejection, reiterating that unregistered sale documents do not create title, and that a reasoned rejection under Order VII Rule 11 operates as res judicata.


3. Relevant Facts

  • Original Owner: Late Sh. Basheshar Dayal, grandfather of the plaintiff, was the absolute owner of property No. 1510, admeasuring 350 sq. yards in Najafgarh, Delhi.

  • Will of Grandfather (1981): Basheshar Dayal executed a Will on August 12, 1981, bequeathing all immovable properties to his son Shiv Dhan Gupta (father of plaintiff). The plaintiff had no right under this Will.

  • Alleged Sale (1998): The plaintiff claimed that on January 7, 1998, his grandfather executed an unregistered GPA, Agreement to Sell, Affidavit, and Receipt in his favour for 145 sq. yards, for which he paid Rs. 4,05,000/-.

  • First Suit (2020): The plaintiff filed Suit No. 677/2020 for partition, possession, and injunction against his father Shiv Dhan Gupta and others. This suit was rejected under Order VII Rule 11 CPC on October 31, 2022, with findings that the plaintiff had no right, title, or interest in the property.

  • Appeal Withdrawn (2023): The plaintiff filed RFA No. 58/2023, which was withdrawn on May 3, 2023, with liberty "to file any other appropriate proceedings in accordance with law."

  • Will of Father (2022): Shiv Dhan Gupta executed a Will on February 3, 2022, bequeathing properties to Shivam Mittal and disinheriting the plaintiff. The father died on August 22, 2022.

  • Second Suit (2023): The plaintiff filed the present suit in September 2023 for declaration of ownership, possession, and permanent injunction based on the 1998 documents.
