The Court held that while the employer failed to prove misconduct, the termination was still valid under the contractual clause permitting termination without cause on three months' notice. However, the Court found that the Trial Court erred in granting relief beyond the pleadings, as the employee had only sought reinstatement and consequential benefits, not a quantified monetary claim.
