2. Judgment in Brief

The Madras High Court dismissed a writ appeal filed by a Secondary Grade Teacher who sought inclusion in the promotion panel for the post of Primary School Headmaster for the year 2021. The appellant had voluntarily relinquished her right to promotion for a temporary period of three years on 20.06.2018, which was accepted by the competent authority. The relinquishment period expired on 16.06.2021. However, the panel for the year 2021 was prepared with the crucial date being 01.01.2021. Since the appellant's name was not eligible as on the crucial date due to the pending relinquishment period, her name was not included in the panel. The Court held that once an employee relinquishes promotion, their name can be considered only after the expiry of the relinquished period. The inclusion in a promotion panel cannot be claimed as an absolute right, though consideration for promotion is a fundamental right of an employee. The Court upheld the Single Judge's order dismissing the writ petition.
