2. Judgment in Brief

The Delhi High Court dismissed a Section 34 petition challenging an arbitral award on the ground of delay. The government department filed the petition 26 days beyond the 90-day limitation period and also had a 122-day delay in re-filing. The Court held that the mere narration of file movement between offices did not constitute "sufficient cause." Following the Supreme Court's decision in Shivamma, the Court observed that government departments are not entitled to preferential treatment in condonation of delay. The bureaucratic lethargy and routine administrative delays were not sufficient to condone the delay. The petition was dismissed as barred by limitation.
