2. Judgment in Brief

The Delhi High Court directed the Sub-Registrar to register a sale deed that had been kept pending on account of ongoing consolidation proceedings in Village Singhola. The petitioner had filed a writ petition seeking registration of the sale deed, which was being refused due to non-availability of No Objection Certificate/Land Status Report from the Consolidation Officer. The Court followed its earlier decision in Okaya Infocom Pvt. Ltd. and Payal Bansal, holding that registration of sale deeds cannot be indefinitely withheld solely on the ground of pending consolidation proceedings. The Court directed registration subject to the purchaser furnishing an undertaking that they shall be bound by the consolidation proceedings. The undertaking was taken on record and directed to form part of the sale deed. The registration was also made subject to the outcome of a pending contempt petition.
