Synopsis
The National Commission for Backward Classes (NCBC) initiated proceedings based on a land dispute complaint filed by two individuals who claimed that the Sikkim government had demolished their house and shop without notice and constructed a “Hawa Ghar” on their land. The complainants alleged that they were from the backward class (Barber caste) and had not received justice. The Commission directed the personal appearance of the Chief Secretary and the District Collector. The State of Sikkim challenged this direction. The High Court held that the direction for personal appearance was unwarranted because the State was represented by counsel and there was no allegation of non‑cooperation. The court set aside the personal appearance direction, but allowed the Commission to continue proceedings and permitted the petitioners to raise jurisdictional objections through their representatives.
