The appellant (an NRI) purchased a residential plot in a layout developed by Joseph Chacko. She alleged that certain accused persons, including K.S. Shankar Reddy, K.V. Rajagopal Reddy and others, conspired to fraudulently deprive NRI plot owners of their properties by creating forged documents, obtaining confirmation deeds under false pretences, and transferring the lands to themselves. The Magistrate directed police investigation under Section 156(3) CrPC. The High Court quashed the FIR, holding that the dispute was civil in nature and that the registered sale deeds of the accused could not be ignored without first seeking their cancellation under Section 31 of the Specific Relief Act. The Supreme Court reversed, holding that the High Court exceeded its jurisdiction under Section 482 CrPC by evaluating defence documents at a nascent stage. The Court restored the investigation, noting that a similar judgment quashing cases against the developer had already been set aside by this Court.
