Citation: 2026 INSC 958 (Reportable)
Bench: Justice Sandeep Mehta and Justice Manmohan
Date of Judgment: September 7, 2026
Area of Law: Criminal Law, POCSO Act, Evidence, Identification, Child Witness
The Judgment in One Line
Supreme Court acquits accused in child rape case, holding prosecution failed due to absence of dock identification and medical evidence contradictions.
Why This Judgment Matters
This judgment reinforces the distinction between Test Identification Parade (TIP) and substantive dock identification in criminal trials. It establishes that TIP is merely corroborative, not substantive evidence, and conviction cannot be based solely on TIP when the accused is not identified in court. The ruling also criticizes trial courts and prosecutors for failing to ensure proper identification procedures. Additionally, it highlights the active role courts must play in eliciting material evidence, especially in cases involving child witnesses. A significant reminder of the high standard of proof required in criminal cases.
Background
A five-year-old girl was allegedly sexually assaulted on December 5, 2016. The FIR was lodged on December 7, 2016, against an unknown person. The accused was arrested on February 5, 2017, nearly two months later. The victim identified the accused in a Test Identification Parade. However, during her court testimony, while she stated she could identify Dhanraj if he came before her, no dock identification was conducted. The victim also admitted the police had told her the accused's name.
