Synopsis of the Judgment
Dr. Narain, a paediatrician, was appointed as Professor at a medical college in Dehradun (SSSMC) on 03.01.2015 and appeared before an MCI inspection there on 22.01.2015. He resigned on 06.04.2015, rejoined Patna Medical College (PMC) on contract, and signed a declaration form for a surprise inspection at PMC on 05.05.2015. The declaration did not disclose his prior appearance at SSSMC. The MCI Ethics Committee initially exonerated him, but after the Executive Committee referred the matter back, the Committee found him guilty of mis‑declaration and imposed a penalty of removal of name from the Indian Medical Register for three months. The Single Judge quashed the penalty; the Division Bench restored it. The Supreme Court held that the MCI violated natural justice by punishing Dr. Narain on a charge not originally framed, without a fresh show cause notice. However, the mis‑declaration was admitted. Considering his age (76) and the decade‑long pendency, the Court reduced the punishment to a censure/ warning under Article 142 and directed the NMC to issue a warning letter.
