Proportionality in Sentencing: Supreme Court Modifies Life Sentence to 20 Years in Gang Rape Case
Case Snapshot
Case Name: Ehsaan v. State of National Capital Territory of Delhi
Citation: 2026 INSC 720
Bench: Justice Sanjay Karol
Date of Judgment: July 20, 2026
Area of Law: Criminal Law, Sentencing, Gang Rape
Judgment in Brief
The Supreme Court partly allowed the appeal and modified the sentence of the appellant-convict from rigorous imprisonment for life (till the remainder of natural life) to 20 years of rigorous imprisonment with the benefit of remission. The Court refused to interfere with the conviction under Section 376D of the Indian Penal Code, 1860 (gang rape), as notice was issued only on the quantum of sentence. The Court applied the doctrine of proportionality and balanced the heinous nature of the offence with mitigating factors such as the appellant's young age (25 years at the time of offence), lack of criminal antecedents, and the possibility of reformation. The Court emphasized that while Section 376D prescribes a minimum sentence of 20 years, the maximum sentence of life imprisonment for natural life should be reserved for cases where aggravating circumstances outweigh mitigating factors. The sentence was modified accordingly.
