Synopsis of the Judgment

The appellant, a Squadron Leader in the Indian Air Force, was dismissed from service in 1993 after being discharged by a criminal court in respect of an incident where a driver died after being left in a desolate location. The disciplinary action was initiated under Section 19 of the Air Force Act read with Rule 16 of the Air Force Rules, after the three-year limitation for court-martial had expired. The Supreme Court held that once the Air Force elected to have the matter tried by a criminal court, the discharge (which stands on a higher footing than acquittal) brought finality, barring any subsequent disciplinary action. Additionally, the reasons recorded (“morally convincing evidence”) were vague, the reply to show-cause notice was not properly considered, and the punishment was arbitrary (superior officer received only “severe displeasure”). The dismissal was set aside, and the appellant was granted 50% back wages, notional promotion, and pensionary benefits with interest.
