Synopsis of the Judgment

The Supreme Court revisited the distinction between the “seat” and “venue” of arbitration. The arbitrator had, with party consent, fixed Srinagar as the seat and New Delhi as the venue of arbitration. The arbitral award was rendered at New Delhi. The High Court of Jammu & Kashmir returned the appellant’s Section 34 petition, holding that since the award was delivered at New Delhi, courts there alone had jurisdiction. The Supreme Court reversed, holding that the designated seat (Srinagar) determines the supervisory jurisdiction, not the venue where hearings were held or the award was signed. The Court reaffirmed that once a seat is designated, it operates as an exclusive jurisdiction clause, and the courts of that place alone have jurisdiction to entertain challenges to the award.
