K Raheja Corp Private Limited vs State of Maharashtra & Ors 2026 INSC 551
Legal Analysis: K. Raheja Corp. Private Limited v. State of Maharashtra & Ors
Citation: 2026 INSC 551
Court: Supreme Court of India
Bench: A Division Bench comprising Justice Pamidighantam Sri Narasimha and Justice Alok Aradhe
Date of Decision: May 26, 2026
Nature of Judgment: Civil Appeals arising out of the common judgment of the Bombay High Court in PIL Nos. 131 of 2003 and 48 of 2004.
Synopsis of the Judgment
The Supreme Court dealt with the legality of an allotment of land made by CIDCO to a developer for constructing a shopping mall and hotel in Navi Mumbai, which was held to be illegal and arbitrary by the High Court. The High Court directed demolition and restoration of the land. The Supreme Court, applying the doctrine of proportionality, set aside the demolition order and substituted it with a regularisation conditioned upon payment of full market value as of 2014 (the date of the High Court’s judgment) plus interest, amounting to approximately Rs. 318 crores. The Court held that the public interest in preserving a fully operational commercial complex, protecting 8,000 livelihoods, and avoiding catastrophic economic harm outweighed the remedy of demolition. The Court accepted the Banthia Committee’s recommendation over the Sankaran Committee’s methodology, ruling that regularisation must be prospective and based on the land’s value at the time of judicial declaration of illegality, not at the time of the original irregular allotment.
