The defendant claimed hereditary ownership through successive adoptions. The Trial Court and High Court decreed the suit, relying on documents showing appointment of the defendant and his predecessors as pujaris, and rejecting the defendant’s adoption story. The Supreme Court reversed, holding that the plaintiffs failed to discharge the burden of proving their own title to the property. Management of a temple and appointment of pujaris, without any deed of dedication or endowment, does not establish ownership. The plaintiff must succeed on the strength of his own title, not on the weakness of the defendant’s case. Suit dismissed.
