This judgment is a significant clarification on the scope of Section 12 of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986. The Supreme Court has held that the provision only requires that in the event of a clash of dates between proceedings under the Gangsters Act and other cases against the same accused, the Gangsters Act trial shall get precedence. It does not mandate that all other trials must be kept in abeyance until the Gangsters Act trial is concluded. The judgment also reaffirms that the right to speedy trial under Article 21 belongs not only to the accused but also to the victim, and any interpretation that delays trial would be unconstitutional.
Background
In the case of Keshvendra Singh v. Shankar Singh and Anr., an FIR was lodged on September 30, 2023, under Sections 147, 323, 504, 506, 302, and 427 IPC against 9 accused persons, including the first respondent, for the murder of Raghvendra Singh. After investigation, charge sheets were filed against 7 accused persons in October 2023. On November 27, 2023, cognizance was taken, and on December 8, 2023, the case was committed to the Sessions Court as Session Trial No. 0934 of 2023.
