Synopsis

The appellant, a bus driver employed with the Bengaluru Metropolitan Transport Corporation (BMTC), was convicted under Section 304-A of the Indian Penal Code, 1860 (IPC) (causing death by negligence) and Section 134(b) read with Section 187 of the Motor Vehicles Act, 1988 (MVA) for a fatal accident that occurred on 27.12.2011. The Trial Court and the First Appellate Court upheld the conviction and sentence of six months imprisonment. The High Court, in revision, partly allowed the appeal, upholding the conviction under Section 304-A but reducing the sentence to the period already undergone (two months) and imposing a fine. The Supreme Court, while confirming the conviction, granted the benefit of probation under Section 3 of the Probation of Offenders Act, 1958, and commuted the sentence to a fine of Rs. 5,00,000/- to be paid as compensation to the family of the deceased. The Court further directed that the appellant shall not incur any disqualification affecting his service career under Section 12 of the 1958 Act.
