The appellant (landlord) sought eviction of a sub-tenant on the ground of bonafide need. The trial court decreed eviction, but the first appellate court reversed it, holding that the need ceased after the death of the widow (the primary person requiring the premises). The High Court, in writ petition under Article 227, dismissed the landlord’s challenge solely on the ground that the landlord failed to file a rejoinder to the tenant’s affidavit alleging that another room available to the landlord had been let out. The Supreme Court held that the High Court erred in dismissing the writ petition on the sole ground of non-traverse without examining the entire material. It remanded the matter to the trial court to decide afresh, allowing parties to amend pleadings and lead evidence, while clarifying that subsequent events must materially affect the bonafide need as on the date of the suit.
