Synopsis of the Judgment

The Supreme Court considered whether the limitation period for filing an application under Section 34 of the Arbitration and Conciliation Act, 1996 would commence from the date of the arbitral award or from the date on which applications filed under Section 33 of the Act were disposed of by the Arbitral Tribunal.

The National Highway Authority of India (NHAI) had filed an application under Section 33(1)(a) seeking correction of the arbitral award, while the landowner also filed an application under Section 33(4) seeking an additional award. Both applications were dismissed by a common order. Thereafter, NHAI filed applications under Section 34 along with applications for condonation of delay.

The Karnataka High Court held that NHAI’s Section 33 application was not maintainable and therefore could not extend the limitation period under Section 34(3). Consequently, it held the Section 34 applications to be time-barred.

The Supreme Court reversed the High Court and held that once the jurisdiction of the Arbitral Tribunal under Section 33 is formally invoked and such applications are entertained and decided, the limitation under Section 34(3) begins from the date of disposal of the Section 33 proceedings irrespective of whether those applications are ultimately allowed, dismissed, or found to be without merit. The appeal was accordingly allowed.
