Nature of Judgment: Civil Appeals under Article 136 against NGT orders directing closure of formaldehyde manufacturing units for want of prior Environmental Clearance (EC).

Synopsis of the Judgment

The appellants (formaldehyde manufacturing units in Rajasthan and Haryana) were established and operating on the basis of Consent to Establish (CTE) and Consent to Operate (CTO) granted by the respective State Pollution Control Boards (PCBs). The PCBs themselves were initially unaware that formaldehyde manufacturing required prior EC under the EIA Notification 2006. Upon realisation, they directed the units to apply for EC, which the appellants did. The NGT, relying on its earlier order in Dastak N.G.O., directed closure of all such units for want of prior EC. The Supreme Court, applying its judgment in Pahwa Plastics Pvt. Ltd. v. Dastak NGO (2022), held that the same reasoning applied. The NGT order was set aside. The units were allowed to operate pending decision on their EC applications, which had already reached the final stage of appraisal. The Court distinguished the subsequent Vanashakti judgment (striking down ex-post facto EC) as inapplicable because the review of that judgment had been allowed and the OM dated 07.07.2021 was not the basis here.
