Synopsis of the Judgment

The Delhi Development Authority (DDA) decided to translocate hundreds of deer from A.N. Jha Deer Park, Hauz Khas, New Delhi to wildlife sanctuaries and tiger reserves in Rajasthan, after the Central Zoo Authority cancelled the park’s recognition as a “mini zoo” due to persistent non‑compliance with zoo management norms. The New Delhi Nature Society challenged the translocation. The Supreme Court, after receiving a detailed report from the Central Empowered Committee (CEC), accepted the CEC’s recommendations. It held that the deer park lacks the carrying capacity to sustain the large deer population and that deer, being wildlife, ought not to be confined to restrictive enclosures. The Court directed translocation under scientific protocols, allowed retention of up to 38 deer only if the DDA obtains fresh approval from the Central Zoo Authority, and mandated that the land be maintained as a protected forest. It also directed that the draft guidelines on wildlife translocation prepared by the CEC be examined and implemented by the Ministry of Environment, Forest and Climate Change within six months and given statutory status.
