Synopsis

This judgment, delivered by the Supreme Court of India on March 13, 2026, arises from a civil appeal filed by a successful auction purchaser against a limited remand order passed by the Madras High Court. The core dispute concerns a recovery proceeding initiated by Indian Bank against a borrower company and its guarantors. The Supreme Court dismissed the appeal, holding that while the rights of a bona fide auction purchaser deserve protection, this protection is not absolute. Where a credible question regarding the adequacy of valuation or the fixation of the reserve price arises, a court can order a re-examination without necessarily unsettling the concluded sale, to ensure the recovery process was fair and fetched the best possible price.
