A US District Court had entered an ex‑parte judgment against the Indian firm, awarding damages for breach of joint venture agreement and fraudulent inducement. The complainant then lodged an FIR in Bangalore alleging forgery and cheating. The police filed closure reports twice, noting the civil nature of the dispute. However, a third investigation was conducted without express permission of the Magistrate, leading to a charge-sheet. The Supreme Court quashed the proceedings, holding that (i) further investigation under Section 173(8) CrPC without prior leave of the Magistrate is impermissible as per settled law; and (ii) even on merits, the dispute was essentially civil in nature, falling under Category (3) of Bhajan Lal, and the allegations of forgery were not supported by timely production of evidence before the foreign court. The appeal was allowed.
