Synopsis of the Judgment
The son of the de facto complainant went missing on the evening of 31.10.2012 and was found dead the next morning in a field, head down with legs sticking up from a ditch. Three companions with whom the deceased was last seen were accused. The trial court convicted them based on the last seen together theory, extra-judicial confession, recovery of weapons and a motorcycle, and serological reports. The High Court affirmed. The Supreme Court allowed the appeals of A1 and A2 (the third accused did not appeal). The Court held that: (i) the time gap between the last seen together (5 PM on 30.10.2012) and death (autopsy indicated death within 24 hours – a wide, elastic window) was not proximate enough to sustain conviction on that circumstance alone; (ii) the extra-judicial confession made by A1 when detained by a mob was unreliable, as the witnesses gave contradictory versions and the accused had injuries suggesting duress; (iii) the recoveries under Section 27 of the Evidence Act were not proved – there was no statement of concealment, the seizure list was vague, and the weapons were not shown to the doctor; (iv) the witness PW4 (aunt of A3) turned hostile and was unreliable; (v) the witness PW11 (who claimed to have seen the four drinking) could not identify her employer or the locality. Consequently, the chain of circumstances was incomplete, and the conviction was set aside. The Court further directed the National Legal Services Authority to assist the third accused (who had not appealed) to file an appeal.
