Synopsis of the Judgment

The dispute involved a 1600 sq. yard plot originally reserved for a High School in a 1958 layout plan. The reservation was deleted in 1969 due to insufficient area. The coloniser sold the land to private parties in 1975. A civil suit for permanent injunction was decreed in 1988, restraining the MCD from forcible dispossession. The decree attained finality as appeals were dismissed. Subsequent purchasers (including appellants) bought the land in 1994 and applied to the MCD for incorporation of their plots in the layout plan. The MCD rejected the application, claiming the land was recorded in its property register. The Single Judge of the Delhi High Court set aside the rejection and directed reconsideration. The Division Bench reversed, holding that the land was earmarked for public purpose and the MCD was its custodian. The Supreme Court set aside the Division Bench’s order, holding that the issue of title had attained finality and the Division Bench had no occasion to delve into it. The Single Judge’s direction to consider incorporation was restored.
