Judgment in Brief

The Supreme Court partly allowed the appeal and directed the respondent-department to grant promotion to the appellant as Deputy Commandant with all attendant benefits from the date of his entitlement, while quashing the contempt proceedings. The Court noted that the appellant, an Assistant Commandant in the CRPF, had his promising career cut short due to administrative callousness and prolonged litigation spanning over two decades. Although the High Court had upheld a minor penalty (reduction to one lower stage for three years), the department delayed implementation and wrongfully denied the appellant his rightful promotions. The Court directed the punishment to relate back to the date of initial termination (July 10, 1995), ending the rigor of punishment by July 10, 1998. The Court also imposed costs of ₹10 lakhs on the respondents for the prolonged litigation.
