The petitioners challenged detention orders passed under Section 3(1) of the COFEPOSA Act against two detenus involved in smuggling foreign-marked gold bars. The detenus were arrested after recovery of 14.2 kg gold from one of them at Bengaluru airport. The High Court of Karnataka upheld the detention. The Supreme Court dismissed the petitions, holding that (i) substantial compliance was made in supplying relied-upon documents including a pen drive containing CCTV footage; (ii) a detenu has no right to legal assistance before the Advisory Board unless the detaining authority itself uses a legal practitioner; (iii) communications of rejection of representations by a ministerial officer do not vitiate the decision; and (iv) the Detaining Authority’s subjective satisfaction as to the live and proximate link was valid.
