Synopsis of the Judgment

The appellants sought correction of certain observations made by the High Court in a revision petition order, which they contended mischaracterised the respondent’s claim and the effect of an earlier High Court order. The Supreme Court held that the observations in paragraphs 6, 13, 14 and 18 of the High Court’s judgment were prima facie erroneous and did not accurately reflect the pleaded position of the respondent or the directions contained in the prior order dated 20.02.2015. While not interfering with the operative part of the High Court’s order (rejection of plaint), the Supreme Court clarified that those observations shall not be construed as findings on title, identity, or location of the suit property and cannot be relied upon by any party in pending proceedings.
