Synopsis of the Judgment

The respondent (daughter of the testator) obtained probate of an unregistered will dated 09.01.1976 in 2009, without impleading her two brothers (or their legal heirs) and without issuing citations to subsequent purchasers (the appellants) who had acquired the property through registered sale deeds from 1997. The District Court revoked the probate under Section 263 of the Indian Succession Act, 1925, holding that the grant was obtained by suppressing material facts and without citing necessary parties. The High Court, in revision under Article 227, set aside the revocation, holding that testamentary jurisdiction does not extend to determining title. The Supreme Court reversed, holding that the High Court exceeded its supervisory jurisdiction. The Court reaffirmed that a person who has an interest in the estate of the deceased, including an alienee who acquired interest before the probate proceedings, is a necessary party. Failure to cite such parties and suppression of material facts constitute “just cause” for revocation under Section 263. The order of the District Court revoking probate was restored.
