The respondents (son and his power agent) sought rejection of the plaint under Order VII Rule 11(d) CPC, contending that the suit was barred under Order II Rule 2 CPC because an earlier suit filed by the parents (seeking injunction) did not challenge the Power of Attorney. The trial court rejected the application, but the High Court allowed the revision and rejected the plaint. The Supreme Court held that a plea under Order II Rule 2 CPC cannot be a ground for rejection of plaint under Order VII Rule 11(d) CPC, as it requires evidence to establish identity of cause of action and omission. The Court restored the plaint for trial.
