The appellant, a scientist with the Indian Council of Agricultural Research (ICAR), was appointed as Assistant Director General (ADG-ARIS) for a tenure of five years “or until further orders, whichever is earlier”. His tenure was curtailed prematurely based on adverse Annual Assessment Reports (AARs) for two consecutive years, which rated his performance as “unsatisfactory” and “below average”. The appellant claimed that this action was retaliatory because he had acted as a whistleblower exposing financial irregularities. He contended that the reversion was stigmatic and punitive, and that he was entitled to protection under Article 311 of the Constitution. The CAT and the High Court dismissed his challenge. The Supreme Court upheld the dismissal, holding that (i) Article 311 does not apply to employees of autonomous societies like ICAR unless they hold a “civil post” under the Government; (ii) the order of curtailment was not stigmatic – language of “unsatisfactory” performance does not impute anything beyond unsuitability; (iii) there was no clear evidence of mala fides; and (iv) judicial review is confined to the decision-making process, not the merits of the decision. The appeals were dismissed.
