Synopsis of the Judgment
The applicant, who claimed to be a Sanyasi, had earlier filed SLP(C) No. 9085 of 2016 concerning land which was allegedly encroached in 2002 by the State Government for construction of a road. The Supreme Court dismissed the SLP on 06.07.2021 after noting that the applicant had already been allotted 0.202 hectares of land in village Malloli in 2005, in addition to receiving compensation. Thereafter, the applicant filed multiple rounds of litigation: a miscellaneous application for recall (dismissed on 27.09.2021), a writ petition before the High Court (disposed of on 12.10.2023), a contempt petition (dismissed as withdrawn), and a review petition (dismissed on 25.09.2024). The applicant then filed the present miscellaneous application challenging the Registrar’s order dated 16.10.2025. The Supreme Court dismissed the application, holding that the applicant had received a much larger plot (0.202 Ha. – approximately 21,000 sq. ft.) in lieu of his original plot (approximately 11,000 sq. ft.) and substantial monetary compensation (Rs.7,58,575/-). The repeated filings amounted to a sheer wastage of the Court’s precious time. The application was dismissed with no orders as to costs.
