Supreme Court Sets Aside Lok Adalat Awards, Holds Title Disputes Cannot Be Resolved Without All Claimants' Consent
Case Snapshot
Case Name: Singapogu Babu Rao & Ors. v. Special Deputy Collector (Land Acquisition) & Ors.
Citation: 2026 INSC 888
Bench: Justice J.B. Pardiwala and Justice Manoj Misra
Date of Judgment: August 19, 2026
Area of Law: Land Acquisition, Lok Adalat, Title Disputes, Civil Procedure
The Judgment in One Line
Lok Adalat awards for land compensation invalid where all disputing claimants were not parties or signatories to the settlement.
Why This Judgment Matters
This judgment is a significant clarification on the limits of Lok Adalat jurisdiction in land acquisition matters. The Supreme Court has held that Lok Adalat cannot adjudicate disputed questions of title without the consent of all disputing claimants. The Court also rejected the practice of conducting "enjoyment surveys" as a basis for determining entitlement to compensation, holding that physical possession does not determine legal title. The judgment reinforces that disputes over apportionment of compensation under Section 30 of the Land Acquisition Act, 1894, must be resolved by a civil court through proper adjudication, not by partial settlements that exclude some claimants. This will protect the rights of landowners in acquisition proceedings.
Background
The respondent acquired 489.04 acres of land for mining operations. The Land Acquisition Officer passed an award on December 30, 2013, determining compensation at Rs. 3,48,935/- per acre. The award was referred to the Principal District Judge under Sections 30 and 31 of the Land Acquisition Act, 1894, for resolution of title disputes and apportionment of compensation.
